These Terms govern the provision of all logistics, clearing and forwarding, shipping, delivery, and consultancy services offered by Forward Path Logistics Limited.

2. Scope of Services
Forward Path Logistics Limited provides a wide range of logistics and supply chain solutions, including but not limited to:

All services are rendered in accordance with international shipping conventions, transport regulations, customs laws, and applicable company policies.
3. Service Engagement
3.1 Booking and Instructions
All service requests must be submitted through official communication channels such as email, telephone, or our website. Customers must provide complete and accurate shipment details, including the nature of goods, origin, destination, weight, declared value, and any specific handling instructions.
3.2 Documentation
Customers are required to supply all necessary documentation (e.g., invoices, packing lists, permits, licenses, or certificates) in a timely manner. Forward Path Logistics Limited shall not be held responsible for delays, penalties, or losses resulting from incomplete or inaccurate documentation.
3.3 Acceptance of Cargo
We reserve the right to reject or discontinue handling of goods that are illegal, hazardous, inadequately packaged, or otherwise non-compliant with transport or customs regulations.
4. Payment Terms
4.1 All payments must be made in full prior to delivery of goods unless otherwise agreed in writing.
4.2 Prices quoted are based on prevailing tariffs, currency exchange rates, and third-party carrier charges. Adjustments may be made in the event of changes in fuel surcharges, customs fees, or exchange rates beyond our control.
4.3 Late payments may attract interest charges as indicated on the invoice.
5. Liability and Limitation
5.1 General Liability
Forward Path Logistics Limited exercises utmost care in handling shipments. However, our liability is limited to proven direct loss or damage caused by our negligence, subject to applicable international conventions such as the Hague-Visby Rules or Warsaw/Montreal Convention.
5.2 Exclusions
We are not liable for loss, damage, or delay resulting from:

Acts of God, natural disasters, or war

Port or customs authority delays
-
Insufficient packaging or mislabeling

Inherent defects in goods

Government restrictions or strikes
-
Any event beyond our reasonable control
5.3 Limitation of Claims
Unless a higher value is declared and insurance coverage is arranged, liability shall be limited as follows:

For air freight: according to international air transport conventions

For sea freight: to the standard maritime liability per package or unit

For domestic parcels: to the declared value at booking
6. Insurance
Forward Path Logistics Limited offers optional insurance coverage for goods through an approved insurer. Insurance is not automatically included in our service fees. Customers who wish to insure their shipments must declare value and request coverage in writing before dispatch.
In the event of loss or damage, the customer must notify Forward Path Logistics Limited in writing within 14 days of delivery or expected arrival, and provide all supporting evidence required to process the claim with the insurer.
7. Delivery and Transit
7.1 Transit times are estimated and may vary depending on customs clearance, carrier schedules, weather conditions, or unforeseen delays. Forward Path Logistics Limited does not guarantee delivery dates unless expressly agreed in writing.
7.2 Goods are considered delivered once received and signed for by the consignee or their authorized representative at the delivery address.
7.3 If delivery cannot be completed due to incorrect address, refusal of goods, or legal restrictions, the shipment may be held, returned, or disposed of in accordance with applicable laws, and all additional costs will be borne by the customer.
8. Customer Obligations
Customers agree to:

Provide accurate and truthful shipment information.

Ensure goods are properly packaged, labeled, and secured for transit.

Comply with all relevant import/export and customs laws.

Make timely payments in accordance with agreed terms.

Cooperate with Forward Path Logistics Limited in providing documents or information necessary for clearance or transport.
9. Confidentiality and Data Protection
Forward Path Logistics Limited respects the privacy of all customers. Personal and shipment information provided to us is handled with strict confidentiality and used solely for logistics operations, communication, and record-keeping.
We do not sell or disclose customer information to third parties except where required by law or necessary for service delivery (e.g., customs authorities, carriers, or insurers).
10. Consultancy and Advisory Services
Our logistics consultancy and advisory services are provided based on professional experience and available market data. While every effort is made to ensure accuracy, such information is advisory in nature. Forward Path Logistics Limited shall not be liable for business or financial decisions made solely based on consultancy recommendations without independent verification by the customer.
11. Dispute Resolution
In the event of any disagreement or dispute, both parties shall first seek an amicable resolution through negotiation. If unresolved, disputes shall be referred to arbitration in accordance with the Arbitration Act of the governing jurisdiction.
12. Governing Law
These Terms and Conditions are governed by and interpreted in accordance with the laws of [insert country, e.g., Sierra Leone]. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of its courts.
